§ 01

Terms of Service

Hardware + software licence

1.1 The agreement

By reserving or purchasing a Heeeven Machine, or by downloading or using the Heeeven application, you agree to these Terms of Service with Heeeven Ltd, a company registered in Scotland under company number SC888751, having its registered office in Edinburgh, United Kingdom ("Heeeven", "we", "us"). If you do not agree, do not reserve, purchase, or use the product.

1.2 Licence grant

The Heeeven Machine ships with the Heeeven desktop application pre-installed, and your purchase includes the first year of the Heeeven software subscription. Heeeven grants you a non-exclusive, non-transferable, revocable licence to install and use the Heeeven desktop application on up to two (2) devices for the duration of your active software subscription, subject to these Terms. You own the Machine hardware once paid for in full; the software remains the intellectual property of Heeeven Ltd at all times. You do not acquire any ownership of the software, source code, indicators, or related materials.

1.3 The Heeeven Machine

The Heeeven Machine is a limited run of two hundred (200) numbered, hand-built workstations. The total price is £2,499, which includes the hardware and the first year of the Heeeven software subscription. You reserve a numbered Machine with a £699 deposit; the remaining balance is due before your Machine ships. Machines are built to order and ship in approximately seventeen (17) weeks from order confirmation. After the first year, the Heeeven software subscription renews at £799 per year; you may decline renewal and continue to own and use the hardware, with the application reverting to its unsubscribed state. The £699 deposit is fully refundable up until we confirm your build into production — see §3. Reservations are accepted for a single limited founding run of two hundred (200) Heeeven Machines, at the Company's discretion. Once that run is fully reserved, no further founding reservations are accepted.

1.4 Reservations, deposits and cancellation

The Heeeven Machine is a physical product sold at a distance. Your £699 reservation deposit is fully refundable at any time before we confirm your Machine into the build queue; to cancel and request your deposit back, email support@heeeven.com. Because each Machine is hand-built to order, once we have confirmed your build and begun assembly the deposit is no longer refundable on change-of-mind grounds, save where the law requires otherwise. This does not affect your statutory rights: under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you have a 14-day right to cancel a distance purchase of goods running from the day you receive the Machine, and under the UK Consumer Rights Act 2015 you remain entitled to a repair, replacement, or refund if the Machine or software is faulty, not as described, or unfit for purpose. The first-year software included with the Machine is delivered pre-installed on the hardware and is treated as part of the goods; the optional annual renewal (§1.3) is a separate digital subscription to which the standard cancellation rules for digital services apply.

1.5 Permitted use

You may use Heeeven for your own personal or business trading analysis. You may not (a) reverse engineer, decompile, or disassemble the software, (b) resell, sublicence, or redistribute the software or any of its indicators, (c) use the software to provide a competing service, (d) circumvent licence enforcement, or (e) use the software in any way that violates UK law or harms Heeeven's reputation.

1.6 No financial advice

Heeeven is software, not financial advice. Heeeven Ltd is a software publisher, not an authorised financial services firm. We do not hold client funds, execute trades on your behalf, or provide personalised investment recommendations. The software helps you analyse markets and place orders through your own broker. All trading decisions and consequences are yours alone. Trading carries substantial risk of loss; past results do not predict future returns.

1.7 Liability

Subject to your statutory rights under the UK Consumer Rights Act 2015 and other applicable consumer protection law, Heeeven Ltd's total liability arising from or in connection with this agreement is limited to the total amount paid by you for your Heeeven Machine and software subscription in the twelve months preceding any claim. Heeeven is not liable for trading losses, broker downtime, market data delays, or any indirect, consequential, or special damages. Nothing in these Terms limits liability for death, personal injury, fraud, or any liability that cannot be excluded by UK law.

1.8 Termination

You may cancel at any time by emailing support@heeeven.com. Heeeven may terminate your licence for material breach of these Terms with reasonable notice, except for breaches involving fraud, security violations, or illegal use, where termination may be immediate. On termination, your right to use the software ends; your statutory refund rights remain unaffected.

1.9 Governing law

These Terms are governed by the laws of Scotland, United Kingdom. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Scottish courts.

A formal binding End User Licence Agreement is provided to each customer at checkout. These plain-English Terms summarise the headline points and form part of that contract. In the event of any conflict, the EULA accepted at checkout prevails.

§ 02

Privacy Policy

2.1 Data Controller

Heeeven Ltd, a private company limited by shares registered in Scotland under company number SC888751, with registered office at 5 South Charlotte Street, Edinburgh, Scotland, EH2 4AN, United Kingdom, is the Data Controller for personal data processed in connection with the Heeeven application and website. Contact: legal@heeeven.com.

The person responsible for data protection is Mr Aston Ehi Egbiki. Data-protection enquiries and rights requests should be directed to legal@heeeven.com.

Heeeven Ltd is registered with the UK Information Commissioner's Office (ICO) under the Data Protection Act 2018, registration number ZC144456 (registered 11 May 2026, Tier 1). You can verify the entry at ico.org.uk/ESDWebPages/Search.

2.2 What we collect

We collect the minimum personal data needed to operate the service:

  • Account & order data. name, email, billing address, shipping address (needed to deliver your Machine), and country (collected at checkout via Stripe).
  • Payment data. handled entirely by Stripe Inc. and Klarna Bank AB. Heeeven Ltd does not see or store your full card or bank account details.
  • Licence telemetry. periodic check-ins from your installed Heeeven application to verify your licence is active. This includes a randomised machine identifier and the licence key. No trading data, charts, or strategy data is transmitted.
  • Support correspondence. emails you send to our addresses (legal@, founders@, support@) are stored to manage the conversation.

2.3 What we do not collect

Heeeven is local-first. We do not collect your trading positions, P&L, charts, indicator settings, watchlists, broker API keys, market data, or any decisions made within the application. That information stays on your machine. No telemetry of trading activity is transmitted to Heeeven Ltd or any third-party.

2.4 Lawful basis for processing

We process personal data on the lawful bases of (a) contract performance, to provide the licensed software you purchased, (b) legitimate interest, to verify active licences and prevent fraud, (c) legal obligation, for tax, accounting, and statutory record-keeping, and (d) consent, where you have explicitly agreed (e.g. marketing emails, which you can opt out of at any time).

2.5 Sub-processors

Personal data is shared only with the third parties strictly required to operate the service:

We do not use behavioural advertising trackers, marketing pixels, third-party analytics, or session recording tools.

2.6 Data retention

Account and payment data are retained for the duration of your subscription and for six years afterwards to satisfy UK accounting and tax obligations. Support correspondence is retained for two years unless required longer for an active dispute. Marketing data is deleted within 30 days of opt out.

2.7 Your rights under UK GDPR

You have the right to (a) access the data we hold about you, (b) rectify any inaccuracies, (c) request erasure subject to our legal retention obligations, (d) restrict or object to processing, (e) data portability, and (f) lodge a complaint with the UK Information Commissioner's Office (ico.org.uk) if you believe your rights have been violated. To exercise any of these rights, email legal@heeeven.com and we'll respond within 30 days.

2.8 International transfers

Some of our sub-processors (notably Stripe and Cloudflare) operate infrastructure outside the UK. Where personal data is transferred internationally, we rely on the UK adequacy framework or Standard Contractual Clauses to ensure your data remains protected at UK-equivalent standards.

2.9 How to spot a fake Heeeven (phishing protection)

Trading platforms attract phishing copycats. To protect yourself, the rules are simple.

  • The only legitimate domain is heeeven.com. We do not operate Heeeven on any other URL.
  • Payments — your reservation deposit and balance — are taken only on Stripe's hosted checkout, reached via heeeven.com. No other URL takes payment.
  • We will never email you asking for your card number, bank details, seed phrases, broker passwords, two-factor codes, or remote access to your computer. If a message claims to be Heeeven and asks for any of those, it is a phishing attempt.
  • Our email always comes from @heeeven.com (typically founders@, support@, or legal@). We sign our email with DKIM and publish DMARC at policy reject, so a properly configured inbox will reject spoofed messages automatically.
  • Suspect a copycat site or a phishing message? Forward it to legal@heeeven.com. The founder reviews every report personally and we file takedowns where we can.

§ 03

Refund Policy

Heeeven Machines are hand-built to order. You reserve a numbered Machine with a £699 deposit; the balance of the £2,499 price is due before your Machine ships, approximately 17 weeks from order confirmation. The price includes the first year of Heeeven software.

Your deposit is fully refundable until we start building. Up to the point we confirm your Machine into the build queue, you can cancel and get the full £699 back, no questions asked. After we begin assembly your built-to-order Machine, the deposit is non-refundable on change-of-mind grounds — but your statutory rights below are never affected.

  • ·Fully refundable deposit before build. The £699 reservation deposit is refunded in full on request at any time before we confirm your build into production. Email support@heeeven.com.
  • ·14-day cancellation on delivery. Under the UK Consumer Contracts Regulations 2013, you may cancel this distance purchase within 14 days of receiving your Machine and return it for a refund of the price paid, in line with those Regulations.
  • ·Faulty, damaged, or not as described. Under the UK Consumer Rights Act 2015, if your Machine or its software is faulty, damaged in transit, not as described, or unfit for purpose, you are entitled to a repair, replacement, or refund. This covers the hardware and the included software.
  • ·Software renewal is optional and separate. After year one, the Heeeven software renews at £799/year. You can cancel renewal at any time before it bills; the renewal is a separate digital subscription and you keep your hardware regardless.
  • ·Full refund if we can't deliver. If Heeeven Ltd ceases operations or is otherwise unable to deliver your Machine before it has shipped, your deposit and any balance paid are refunded in full.
  • ·Statutory rights always preserved. Nothing in this policy reduces your rights under the UK Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013.
